The oil should be between the min and max marks. Not at the top mark. The glass will never show the same level twice. Do not be in a rush to top up. It may be low one day and back to normal the next.
The oil check procedure is an arcane dance - from cold start the engine on centre stand on level ground to circulate the oil then switch off. How long to run it as for piece of string, until it is warm, maybe feel the rocker cover, 10 minutes may overheat - too long. Wait several minutes for the oil to fall, go and have a cuppa. Look at glass. It will never show the same level twice.
If you wait overnight the oil will fall too far and the level will be too high.
Slightly under-filled is ok; there is an excess quantity of oil in the motor, the pumps will actually suck with a good half litre missing (I don't recommend riding it like that though). Any oil showing in the glass is good.
Overfilled is bad, this can cause damage, and it will spit the excess out of the breather.
There are weirs and dams and galleries inside that trap the oil and stop it falling. After a good run if you stop on the side stand, as is normal, the oil goes to one side so when you put it onto the centre stand, the oil level is wrong. It has to run and stop, from cold, on the centre stand.

Sounds like there are galleries and baffles in there to stop the oil slurping around and building up in one place; which looks like that system is a failure.
